Privacy policy and cookie policy
§ 1 Personal data
As defined in the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), hereinafter RODO, by Personal Data means information about an identified or identifiable natural person (“data subject”); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person.
§ 2 Personal data administrator
The Administrator of Users’ data is Star Dust spółka z ograniczoną odpowiedzialnością, with registered office in Wrocław, 50-029 Wrocław, entered into the Register of Entrepreneurs by the District Court for Wrocław Fabryczna, VI Economic Department of the National Court Register under KRS number: 0000855626, holding NIP: 897-188-23-72 and REGON 386850587.
§ 3 Collection of personal data
(1) Personal data is collected for the purposes of:
subscribing to the newsletter,
creating an account on the Site
placing orders (for Users who do not have an account on the Site).
(2) When signing up for the newsletter, we collect personal data such as : email address.
(3) When filling out the Account registration form, we collect personal data such as : name, surname, email address, telephone number, address data for issuing FV.
(4) When placing orders by Users who do not have an account on the Website, we collect such personal information as: name, surname, email, telephone number, address data for shipment of goods.
§ 4 Purpose of personal data collection
(1) Personal data collected when signing up for the newsletter are collected for the purpose of marketing activities towards Users, including analytical and statistical purposes.
(2) Personal data collected when creating an account on the Website are processed for:
concluding and executing an agreement for the provision of services electronically, i.e. enabling the User to use our Website;
concluding and performing a sales contract (at a distance), the subject of which are goods available in our online store;
to consider complaints that may be filed in connection with the purchase of goods in our online store;
investigation or defense against claims arising from the conclusion of the aforementioned agreements;
to conduct marketing of products and services, including for analytical and statistical purposes;
contacting Users, including for purposes related to permitted marketing activities, through available communication channels, in particular and with the consent of Users – by e-mail and telephone;
(3) Personal data collected when placing orders are processed for:
To conclude and perform a contract for the provision of electronic services, i.e. to enable the use of our website.
To conclude and perform a sales contract (at a distance), the subject of which are goods available in our online store.
to consider complaints that may be filed in connection with the purchase of goods in our store.

§ 5. entrusting processing and sharing of personal data
1. Users’ personal data collected by us may be transferred on the basis of an agreement on entrustment of data processing to entities supporting us in the conclusion and execution of the agreements referred to above, as well as in the investigation or defense against claims, in the performance of obligations under the law, and also supporting us in the provision of marketing services, including in particular: entities providing consulting, advisory, auditing, legal, tax, accounting assistance, research agencies acting on our behalf, the Polish Post, courier companies, IT service providers, marketing agencies, as well as entities related to us personally or by equity, and our business partners.
(2) With your consent, your personal data may be shared with our affiliates and our business partners for the purpose of direct marketing of their products and services.
§ 6 Users’ rights related to data processing
(1) The User has the right to access his/her data and the right to request rectification, erasure or restriction of their processing.
(2) To the extent that the basis for personal data processing is the performance of a contract or the User’s consent – the User has the right to transfer the provided personal data to another administrator.
(3) To the extent that the basis for data processing is the legitimate interest of the Administrator – the User has the right at any time to object to the processing of his personal data.
(4) In order to exercise the rights referred to in paragraphs 1-3, the User should contact the Data Protection Officer designated by the Administrator by e-mail at www.yoshi.com.pl or by letter to the Administrator’s registered office address indicated above.
(5) The User shall also have the right to lodge a complaint to the supervisory authority dealing with personal data protection.
§ 7 Data Protection Officer
The Administrator has appointed a Data Protection Officer (DPO), responsible for ensuring compliance with the provisions of the RODO, providing recommendations on data protection impact assessments, and cooperating with the supervisory authority.
§ 8 Cookies
Cookies are small text information in the form of text files, sent by the server and stored on the end device of Users visiting the website https://yoshi.com.pl (e.g. on the hard drive of a computer, laptop, or on the memory card of a smartphone – depending on the device used by the User).
On the https://yoshi.com.pl website we use our own cookies: session cookies and permanent cookies. Proprietary cookies are used for: maintaining the User’s shopping cart and session; remembering the language version and the country of delivery; remembering the reference code (where the customer came to us from); remembering the data entered in the order form – form of delivery and payment, delivery address and billing address; remembering the User’s preferences, e.g. sorting settings, whether to show him some messages again, etc.
We also use external cookies from entities we partner with, such as Google, Facebook. Due to the fact that the way some cookies from external partners work may be different than presented in this policy, and we cannot control the cookies posted by third-party sites, please read the information about these cookies available on the websites of our partners, e.g. Google: https://www.google.pl/intl/pl/policies/technologies/cookies/ and Terms of Use of Google Analytics, Facebook: http://www.facebook.com/help/cookies [p1].
We also use Tracking pixels (a.k.a. web bugs), which perform a similar function to cookies, but are unrecognizable to the user. Tracking pixels are used by us to measure user behavior on the site, to send newsletters, and to tailor offers in remarketing advertising. The data is anonymous and is not linked to personal data on the User’s terminal device or any database. In order to disable the web bug while using our website, you can use tools such as webwasher, bugnosys or AdBlock (for Firefox browser). In order to disable the web bug in a newsletter, you need to change the settings of your email program so that it does not display messages in html. Web bug also does not work when messages are read offline.
By default, most web browsers available on the market accept cookies by default. Each User has the ability to determine the conditions of use of cookies through the settings of their own web browser. This means that you can, for example, partially restrict (e.g. temporarily) or completely disable the possibility of saving cookies. However, restrictions on the use of cookies may affect the operation of some of the functionalities available on https://yoshi.com.pl.

For the Mozilla Firefox web browser:
1. at the top of the Firefox browser window, press the Firefox button, (in Windows XP, click the Tools menu) and select “Options”.
2. select the “Privacy” panel.
3. select “will use user history settings” from the “Firefox” drop-down menu.
4. uncheck the “Accept cookies” function.
5. press “ok.”
For Google Chrome web browser:
1. At the top of the Chrome browser window, click on “Chrome menu” – the icon with three dashes on the browser toolbar.
2. select “Settings.”
3. click “Show advanced settings.”
4. in the “Privacy” section, click the “Content settings” button.
5. In the “Cookies” section, click “All cookies and site data” to open the “Cookies and other data” dialog box.
6. select “Block attempts to put data from sites on your computer”.
